Contractual and consumer information for buying used auto parts online from dezShop

1. Trader identity and contact details
These terms apply to sales made on dezshop.eu by Terra Cycle SRL, tax ID RO37298322, registered with the Trade Register under number J2017000856137. The registered office is located at Loc. Eforie Nord, Oras Eforie, Aleea Ghiocelului nr. 7, Jud. Constanta, Romania, while the public-facing operational address / work point is Str. Emil Botta, Nr. 16A, Agigea, Constanta, Romania, 907015.

2. Scope and definitions
These terms govern distance sales of auto parts offered on dezshop.eu to both consumers and business customers.
- Seller: Terra Cycle SRL.
- Buyer: any natural or legal person placing an order through the site.
- Consumer: any natural person acting for purposes outside their trade, business, craft, or profession.
- Product: a used auto part or other item offered for sale on the site.
3. Product condition and compatibility
Products sold on dezshop.eu are used auto parts, generally OEM parts recovered from dismantled vehicles. Because they are second-hand goods, they may show normal signs of prior use, storage, handling, or dismantling.
- Photos, descriptions, OEM references, SKU data, engine data, and compatibility information are provided for guidance; the buyer remains responsible for checking vehicle compatibility, ideally using VIN, OEM code, and product specifications.
- Unless expressly stated otherwise, accessories, consumables, coding operations, software, installation work, and any additional services are not included.
- Professional installation by a qualified workshop or technician is recommended.
4. Orders and contract formation
By placing an order through the site, the buyer acknowledges that the order implies an obligation to pay.
- The automatic email acknowledging receipt of the order does not by itself constitute acceptance of the order.
- The contract is concluded when dezShop accepts the order and confirms that acceptance on a durable medium, for example by email.
- Before acceptance, we may refuse or cancel an order in cases including stock unavailability, obvious pricing or description errors, suspected fraud, inaccurate billing or delivery data, or legal or logistical delivery restrictions.
5. Prices, VAT, and payment
Prices shown on the EU storefront are displayed in EUR. VAT treatment shown on the product page and/or at checkout depends on the delivery country and, where relevant, the customer's B2C or B2B status.
- The final order total, including applicable taxes and shipping charges, is shown before the buyer places the order.
- The payment method available at checkout is online card payment (Visa, Mastercard), processed via Stripe.
- For business customers, reverse charge treatment may apply where permitted by law and where a valid EU VAT number is provided before invoicing.
6. Delivery and transfer of risk
We ship to multiple destinations across Europe, subject to legal, technical, and logistical restrictions that may apply to certain products or countries.
- Shipping costs are calculated at checkout.
- Processing and delivery times are estimates unless we explicitly agree otherwise.
- For consumers, the risk of loss of or damage to the goods passes only when the consumer, or a third party indicated by the consumer other than the carrier, physically receives the goods, unless the carrier was independently chosen by the consumer and not offered by us.
7. Consumer right of withdrawal
Unless a legal exception applies, consumers have the right to withdraw from a distance contract within 14 calendar days from delivery of the goods without giving any reason.
- To exercise the right of withdrawal, the consumer must send us a clear statement of withdrawal by email or other unambiguous means, together with the information necessary to identify the order.
- Unless we agree otherwise, or unless the return concerns goods that were non-conforming, incorrect, or damaged on delivery, the direct cost of return shipping is borne by the consumer.
- Refunds are made in accordance with applicable law. We may withhold reimbursement until we receive the goods back or receive adequate proof of return shipment.
- The consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
- This withdrawal section does not apply to business customers.
8. Legal conformity rights and commercial warranty
Mandatory legal conformity rights available to consumers under applicable law are not limited by these terms.
- Used goods sold to consumers are covered by the applicable legal conformity guarantee. If a shorter liability period is expressly agreed for second-hand goods, that period will never be less than 1 year where the law allows such shortening.
- In addition to statutory rights, unless otherwise stated on the product page or invoice, dezShop offers a 30-day commercial warranty from delivery for functional defects not caused by incorrect installation, misuse, impact, unauthorized modification, or normal wear.
- This commercial warranty is additional to, and does not replace, the consumer's statutory rights.
9. Non-conforming, incorrect, or damaged goods
If a product is non-conforming, incorrect, incomplete, or damaged on delivery, the buyer should contact us without undue delay and provide order details and, where possible, relevant photographs.
- Consumers may rely on the remedies available under applicable law, including, where appropriate, repair, replacement, price reduction, or refund.
- Where a complaint is valid and the goods were non-conforming, incorrect, or damaged on delivery, reasonable return and re-shipment costs are borne by dezShop.
10. Liability
Nothing in these terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the fullest extent permitted by law, dezShop is not liable for losses or damage caused by incorrect installation, improper use, failure to verify compatibility, unauthorized modification of the product, or normal wear and tear. Mandatory consumer protections remain unaffected.
11. Personal data and intellectual property
Personal data is processed in accordance with our Privacy Policy.
All texts, photographs, databases, graphics, and other content on the site remain the property of Terra Cycle SRL or its partners unless stated otherwise.
12. Governing law and disputes
These terms are governed by Romanian law, without depriving consumers of any mandatory protections available under the law of their habitual country of residence where such protections apply.
In the event of a dispute, we encourage amicable resolution first. Consumers may also use the competent courts determined by applicable law and available ADR mechanisms.
